Villawood Land Rebate

Villawood $10K Rebate on Nostra Lipari Townhomes

Offer only applicable to Lots 701, 702, 703, 704, 706, 707 at Alamora Stage 7.

Dated 8th April 2025.

In consideration of settlement being completed in accordance with the contract, the vendor agrees to provide an Incentive $10,000 subject to the following terms and conditions:

1. Purchaser complying with all aspects of the Contract;

2. Purchaser complying with the terms and conditions of the Incentive published on Villawood Properties website;

3. Purchaser completing settlement in accordance with the particulars of sale of the Land Contract;

4. Purchaser at no time being in default of any term of the Contract;

5. If the Purchaser does not fully comply with all aspects of the terms of the Contract or do not complete settlement in accordance with the particulars of sale or at any time during the term of the Contract are in default of any term the Purchaser will be ineligible to receive the Incentive;

6. Payment of the Incentive will be made as an adjustment at settlement.

7. The Purchaser acknowledge that:

a) the right to receive this incentive is personal to the Purchaser and is not capable of assignment to any subsequent purchaser, nominee or transferee;

b) the Purchaser must maintain in confidence the terms of this agreement and all information or material disclosed or provided in any form by any party to any other party in connection with the subject matter of this agreement and the Contract and ensure that this information is kept confidential.

Stockland Land Rebate

Rebate/Performance rebate

1. A  Definitions In this special condition: Rebate Amount means an amount equal to $10,000
2. B  Rebate The Vendor will allow a reduction in the Price equal to the Rebate Amount by way of an adjustment against the Balance Price at Settlement, provided that the conditions in clause C of this special condition are satisfied.
3. C  Eligibility conditions The Purchaser will be entitled to a reduction in the Price equal to the Rebate Amount if:
   1. (1)  the Purchaser complies with the terms of this Contract at all times without default from the Day of Sale and until Settlement; and
   2. (2)  the Purchaser completes this Contract on: (a) the Settlement Date first agreed as at the Day of Sale without extension or delay; or (b) such earlier date as agreed between the parties.
4. D  Undertakings by the Purchaser The Purchaser:
   1. (1)  agrees that it will fully disclose the terms of this special condition to any lender who may finance the purchase of the Property promptly following entry into this Contract;
   2. (2)  unconditionally and irrevocably indemnifies the Vendor against all Claims which the Vendor may incur or suffer in connection with any default under clause D(1) of this special condition; and
5. E  Acknowledgement by the Purchaser
   1. (1)  The Purchaser acknowledges and agrees that the State Revenue Office may not take into account the Rebate Amount as a reduction in the Price and may assess stamp duty on this Contract based on the full Price.
   2. (2)  The Purchaser must not Object or make any Claim if stamp duty is assessed on the full Price.

F Dispute

(1) Where there is a dispute in relation to the eligibility for a rebate equal to the Rebate Amount, the Purchaser:

1. (a)  must not delay Settlement; and
2. (b)  must pay the Balance Price in full at Settlement without adjustment in relation to this special condition.

(2) If it is determined following Settlement that the Purchaser is entitled to the Rebate Amount, the Vendor must refund any overpayment of the Price to the Purchaser within 21 days after the determination.
